Terms of Service

These Terms of Service ("Terms") govern all services provided by Ramblr Media ("Company," "we," "our," or "us") to any client ("Client," "you," or "your"). By booking, purchasing, or using our services, you agree to these Terms.

1. Services

The Company provides real estate media services, including but not limited to:

  • Real estate photography

  • Airbnb/STR photography

  • Drone photography and videography

  • Video tours

  • Virtual tours

  • Floor plans

  • Twilight photography

  • Property marketing media

  • Image editing and retouching

Services provided will be limited to those selected and purchased by the Client.

2. Booking and Payment

Booking Confirmation

A booking is not confirmed until it has been accepted by the Company.

Payment

Payment is due according to the invoice terms provided at booking. The Company reserves the right to withhold delivery of media until payment is received in full.

Late Payments

Late payments may be subject to interest charges, collection costs, and suspension of future services.

3. Cancellation and Rescheduling

Client Cancellations

  • Cancellations made more than 24 hours before the scheduled appointment may be refunded or credited at the Company's discretion.

  • Cancellations made within 24 hours of the appointment may incur a cancellation fee of up to 50% of the booking amount.

  • Same-day cancellations may be charged the full service fee.

Rescheduling

The Company will make reasonable efforts to accommodate rescheduling requests but cannot guarantee availability.

Weather and Unforeseen Conditions

For outdoor photography, drone operations, or other weather-dependent services, appointments may be rescheduled due to unsafe or unsuitable conditions.

4. Property Readiness

The Client is responsible for ensuring the property is fully prepared before the scheduled appointment.

The Company is not responsible for:

  • Cleaning

  • Staging

  • Decluttering

  • Landscaping

  • Moving furniture

  • Removing personal items

Time spent waiting for property preparation may result in additional fees or a shortened session.

5. Access to Property

The Client is responsible for ensuring legal access to the property and obtaining all necessary permissions from property owners, tenants, homeowners associations, or other relevant parties.

The Company is not liable for delays or inability to complete services due to lack of access.

6. Drone Services

Drone operations are subject to:

  • Federal, state, and local laws

  • Airspace restrictions

  • Weather conditions

  • Safety requirements

The Company reserves the right to modify or cancel drone services if operations cannot be conducted safely or legally.

No refund shall be due for drone-specific services that cannot be performed because of regulatory restrictions, unsafe conditions, or circumstances beyond the Company's control, except as determined by the Company.

7. Delivery of Media

Estimated delivery times are provided as a courtesy and are not guaranteed.

The Company is not liable for delays caused by:

  • Technical issues

  • Software failures

  • Weather-related disruptions

  • Force majeure events

  • Third-party service interruptions

Media will be delivered electronically through the Company's preferred delivery platform.

8. Copyright and Licensing

Ownership

All photographs, videos, floor plans, and other media created by the Company remain the intellectual property of the Company unless otherwise agreed in writing.

License Grant

Upon full payment, the Client receives a non-exclusive, non-transferable license to use the delivered media solely for marketing and advertising the specific property for which the media was created.

Restrictions

The Client may not:

  • Sell the media

  • Transfer the media to another agent, broker, or third party for a different listing

  • Alter the media in a misleading manner

  • Claim ownership of the media

Any additional use requires written permission from the Company.

9. Portfolio and Promotional Use

The Company reserves the right to use any media created for:

  • Portfolio display

  • Website galleries

  • Social media marketing

  • Advertising

  • Promotional materials

The Client may request exclusion in writing before the scheduled appointment.

10. Property Condition and Accuracy

The Client is responsible for ensuring the property is legally marketed and accurately represented.

The Company does not guarantee:

  • Property condition

  • Measurements

  • Square footage accuracy

  • Listing accuracy

Floor plans and measurements are provided for marketing purposes only and should not be relied upon for construction, appraisal, engineering, or legal purposes.

11. Limitation of Liability

To the maximum extent permitted by law, the Company's liability for any claim arising from services provided shall not exceed the amount paid by the Client for those services.

The Company shall not be liable for:

  • Indirect damages

  • Consequential damages

  • Lost profits

  • Lost business opportunities

  • Listing delays

  • Marketing losses

12. Force Majeure

The Company shall not be liable for failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to:

  • Severe weather

  • Natural disasters

  • Government actions

  • Power outages

  • Equipment failure

  • Internet outages

  • Labor disputes

13. Indemnification

The Client agrees to indemnify and hold harmless the Company, its owners, employees, contractors, and affiliates from any claims, damages, liabilities, costs, or expenses arising from:

  • Property access issues

  • Property conditions

  • Unauthorized use of media

  • Violations of applicable laws or regulations

14. Governing Law

These Terms shall be governed by and construed under the laws of the State of [State], without regard to conflict-of-law principles.

15. Dispute Resolution

Any dispute arising under these Terms shall first be addressed through good-faith negotiation between the parties.

If a resolution cannot be reached, disputes shall be resolved through mediation or binding arbitration in [County, State], unless otherwise required by law.

16. Acceptance

By booking, purchasing, or using services provided by the Company, the Client acknowledges that they have read, understood, and agreed to these Terms of Service.
